Acceptable Use Policy

ZeroTen Media Inc. ("Company," "we," "us," or "our") — a limited liability company formed in the State of Delaware, United States of America (Delaware State File Number: [TBD]; EIN: 35-2937339), with its principal place of business at 1007 N Orange Street, 4th Floor, Wilmington, Delaware 19801, USA.

This Acceptable Use Policy ("AUP") is incorporated into and forms part of our Terms of Service. It applies to all use of the Services, including all Inputs you submit and all Outputs you generate, distribute, or publish. We may update this AUP from time to time; updates take effect on posting.

Violation of this AUP may result in content removal, account suspension or termination, reporting to law enforcement, and the other consequences described in the Terms of Service.

1. Prohibited Content

You may not use the Services to create, upload, or distribute content that:

Child safety

  • Depicts, describes, promotes, or facilitates the sexual abuse, sexual exploitation, or sexualization of a minor — whether real, fictional, simulated, altered, or AI-generated. This is prohibited absolutely and is reported to the National Center for Missing & Exploited Children (NCMEC).
  • Depicts a minor in a sexualized, exploitative, or endangering manner, or generates a minor in a context different from the source material.

Intimate and sexual content

  • Constitutes non-consensual intimate imagery (NCII) — intimate or sexualized content depicting an identifiable real person without their verifiable consent.
  • Is pornographic or sexually explicit.

Identity and likeness

  • Impersonates or resembles the identity, face, voice, likeness, or persona of any real person (living or deceased), entity, or brand without verifiable rights or consent.
  • Falsely depicts a real person saying or doing something they did not, in a manner that creates a false impression of authenticity.
  • Falsely associates a real person with a product, service, candidate, or position they have not endorsed.

Deception and harm

  • Spreads election or voting misinformation, or is intended to suppress or mislead voters.
  • Is defamatory, fraudulent, or intended to deceive, scam, or phish.
  • Promotes or facilitates violence, terrorism, violent extremism, or self-harm.
  • Constitutes hate speech or harasses, threatens, or discriminates against individuals or groups based on protected characteristics.
  • Depicts gratuitous gore or graphic violence.

Intellectual property

  • Reproduces copyrighted characters, copyrighted artworks, or registered trademarks without authorization.
  • Mimics the style of an identifiable living artist in a manner intended to substitute for or be confused with their work.

Illegal and regulated

  • Violates any applicable law, regulation, or third-party right.
  • Facilitates illegal goods, weapons, drugs, or the enablement of weapons of mass destruction.

2. Prohibited Uses

You may not use the Services to:

  • Identify, surveille, track, or stalk any individual based on biometric or behavioral characteristics.
  • Make fully automated decisions affecting any individual's legal rights, or their access to employment, credit, insurance, housing, education, or essential services or benefits.
  • Generate content for use in the administration of justice, law enforcement, immigration, or asylum proceedings, or as evidence in legal or regulatory matters.
  • Present Outputs as authoritative legal, medical, financial, or other regulated professional advice.
  • Engage in any practice prohibited by Article 5 of the EU AI Act, including subliminal or manipulative techniques, exploitation of vulnerabilities based on age, disability, or socio-economic situation, social scoring, and predictive policing.
  • Use the Services in any application where failure could cause death, personal injury, or critical-infrastructure or environmental harm.

3. Prohibited Technical Conduct

You may not:

  • Scrape, crawl, or harvest data from the Services.
  • Reverse-engineer, decompile, or attempt to extract source code, model weights, or training data.
  • Circumvent rate limits, authentication, content filters, or safety systems.
  • Use Outputs to train, fine-tune, or develop any AI or machine-learning system that competes with the Services.
  • Upload malware or interfere with the integrity or performance of the Services.
  • Use bots or automated means to access the Services except through our documented API.
  • Create multiple accounts to evade restrictions, or share or sell account access.
  • Remove, alter, or obscure any watermark, content credential, or provenance metadata applied to Outputs.

4. Biometric and Likeness Features

Features that process facial or vocal characteristics (face swap, voice cloning, lip-sync, avatars, and similar) are not available to residents of Illinois or Texas. For these features and for any upload depicting a real person, the Media Upload Agreement applies, including its consent requirements.

For self-portrait and personal-avatar features, you may upload only media depicting yourself.

5. Public Figures

The fact that someone is a public figure, celebrity, or politician does not remove the consent requirement for using their likeness or voice. Limited exceptions for genuine news reporting, commentary, criticism, and satire are described in the Media Upload Agreement, and never extend to content that creates a false impression of authenticity, conduct, speech, or endorsement.

6. Reporting Violations

7. Enforcement

We may, but are not obligated to, monitor, review, remove, or refuse content, and may suspend or terminate accounts, at our sole discretion. Our exercise of (or failure to exercise) these rights does not create any duty of care. Violations involving CSAM, NCII, or sanctions result in immediate termination. We cooperate with law enforcement and regulators where appropriate.
